Welcome to the Staff Sergeant Reckless Company. These Terms and Conditions (“Terms”) govern your use of our website and the purchase of our military t-shirts and related products (“Products”). By accessing or using our Website, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website or purchase our Products.

1. About Us
Staff Sergeant Reckless Company is a veteran-owned business, dedicated to providing high-quality t-shirts that honor military service and pride. We reserve the right to update these Terms at any time, and any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Website after changes are posted constitutes your acceptance of the updated Terms.

2. Use of Our Website

  • Eligibility: You must be at least 18 years old to use our Website and purchase Products. By using our Website, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.

  • Permitted Use: You may use our Website for lawful purposes only, including browsing, purchasing Products, and contacting us. You agree not to use the Website for any illegal or unauthorized purpose, including but not limited to violating intellectual property rights, distributing malware, or engaging in fraudulent activity.

  • Account Responsibility: If you create an account on our Website, you are responsible for maintaining the confidentiality of your account information (e.g., username, password) and for all activities under your account. You agree to notify us immediately of any unauthorized use of your account at staffsergeantrecklesscompany@proton.me.

3. Product Orders and Payment

  • Order Acceptance: All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud. If we cancel your order, we will notify you and issue a refund for any payment made.

  • Pricing and Payment: All prices are listed in U.S. dollars (USD) and are subject to change without notice. Prices do not include applicable taxes or shipping fees, which will be added at checkout. You agree to pay the total amount due at the time of purchase, including taxes and shipping fees, using the payment methods accepted on our Website (e.g., credit card, PayPal). We do not store your payment information; it is securely processed by third-party payment processors.

  • Product Descriptions: We strive to ensure that all product descriptions, images, and pricing on our Website are accurate. However, we do not guarantee that product descriptions, colors, or other content are error-free. If a Product you receive differs significantly from its description, please refer to our Returns & Exchanges policy for resolution options.

4. Shipping and Delivery

  • Shipping Process: Orders are typically processed within 2-5 business days and shipped via standard methods (e.g., USPS Ground Advantage in the U.S., 2-5 business days). Total delivery time is around 5-20 business days for U.S. orders and 5-15 business days for international orders, subject to delays from carriers, customs, or external factors (e.g., weather, holidays).

  • Shipping Rates: Shipping rates are calculated at checkout based on the order size and destination. For U.S. orders, we charge a flat rate of $5 per order, with free shipping on orders over $65. International rates vary (e.g., $7 to Canada, $8 to Europe or the Rest of World).

  • Customer Responsibility: You are responsible for providing a correct and complete shipping address at checkout. We are not responsible for delays, losses, or additional costs due to incorrect or incomplete addresses. If a package is returned as undeliverable, we will not reship or refund the order; you will need to place a new order at your expense.

  • International Orders: For international orders, you are responsible for any customs fees, import duties, or taxes, which are not included in the product price or shipping fees. We are not responsible for delays or losses due to customs processing.

5. Returns, Exchanges, and Cancellations

  • Returns & Exchanges Policy: Due to the custom, made-to-order nature of our Products, we have a strict returns and exchanges policy. We do not accept returns or exchanges for change of mind, sizing issues, color variations, minor print imperfections, or shipping delays. Returns or exchanges are only accepted for damaged, defective, or incorrect items within 7 days of receipt, as outlined in our Returns & Exchanges policy.

  • Order Cancellations: Orders cannot be canceled or modified once submitted due to immediate processing for fulfillment. If you need to cancel due to an error, contact us within 1 hour of placing your order at staffsergeantrecklesscompany@proton.me, and we will do our best to assist, but cancellation is not guaranteed.

6. Intellectual Property

  • Our Content: All content on our Website, including but not limited to text, images, logos, designs, and product descriptions, is the intellectual property of Staff Sergeant  Reckless Company or our licensors and is protected by copyright, trademark, and other laws. You may not reproduce, distribute, modify, or create derivative works of our content without our prior written consent.

  • Your Content: If you submit content to our Website (e.g., reviews, custom designs), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display that content for the purpose of operating and promoting our business. You represent that you own or have the right to submit such content and that it does not violate any third-party rights.

  • Trademark: “Staff Sergeant Reckless”, “Reckless”, Reckless Records” and “Staff Sergeant Reckless Company” logo are trademarks of the Staff Sergeant Reckless Company. You may not use these trademarks without our prior written consent.

    We reserve the right to terminate your access to the Website if you violate these Terms.

Our total liability to you for any claim will not exceed the amount you paid for the Product giving rise to the claim.

  • External Factors: We are not liable for delays, losses, or damages caused by factors beyond our control, including but not limited to natural disasters, pandemics, strikes, government regulations, or third-party actions (e.g., shipping carrier delays, customs issues).

9. Indemnification
You agree to indemnify, defend, and hold harmless, Staff Sergeant Reckless Company, its owners, employees, and affiliates from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Website, violation of these Terms, or infringement of any third-party rights (e.g., intellectual property, privacy).

  • Dispute Resolution: Any disputes arising from these Terms or your use of the Website will be resolved through binding arbitration, in accordance with the rules of the American Arbitration Association (AAA). You waive your right to participate in a class action lawsuit or class-wide arbitration. If arbitration is not enforceable, disputes will be resolved in the state or federal courts of any County, Washington, and you consent to the jurisdiction of those courts.

11. Termination
We reserve the right to terminate or suspend your access to the Website at our discretion, without notice, for any reason, including but not limited to violation of these Terms, suspected fraud, or illegal activity. Upon termination, your right to use the Website will cease immediately, but these Terms will continue to apply to any prior actions (e.g., orders placed, content submitted).

We are not responsible for the content, functionality, or practices of these third-party sites. Your use of third-party sites is at your own risk and subject to their terms and privacy policies.

13. Force Majeure
We are not liable for delays, failures, or issues caused by events beyond our control, including but not limited to natural disasters, pandemics, strikes, government regulations, or supplier disruptions. In such cases, we will do our best to fulfill your order as soon as possible, but we are not responsible for any resulting delays or cancellations.
